Meetings. What are the requirements according to Florida law?

Florida Statute 720.303 (2)(a) and 720.303 (10) subsection (2) Board Meetings, states that all board meetings shall be open to the members of the homeowners assocation, and 48 hours (2 days) prior notice shall be given. Special meetings due to an emergency are exempt from this provision.

Can Deed Restrictions / By-Laws be changed?

Yes. Reference: Chapter 15.01 Duration of Restrictions of Deed Restrictions – Requires 90% of homeowners positive vote. Recommend that a committee formed to review the Deed Restriction change.

How can I report a violation of neighborhood deed restrictions?

Contact any of the board members or you can fill out the form on the Forms Page and turn that in.

My sidewalk is uneven. Who does the sidewalk maintenance?

All of the sidewalks are maintained by the county. Please call St. Johns County Road & Bridge Department at (904) 209-0246.

I have a company vehicle with commercial signage. Can I park it in my driveway or on the street?

Per our Deed Restrictions, Section 4.10

  1. No vehicles described in this Paragraph shall be parked in any residential area, on any lot, tract, side or rear yard, street, or right of way in this subdivision, except as may be required for normal and customary loading and/or unloading of such vehicles: semi tractors or trailers, tractors, buses (including school or church), recreational vehicles such as motor homes or campers, boats, trailers, canoes, trucks or other vehicles used for commercial purposes, or any other vehicle, vessel or trailer determined by the Board of Directors as reasonably related to others described in this Paragraph. This provision does not prohibit the keeping of any of these vehicles inside a closed garage.
I have to do maintenance on my boat or motorhome, can I park it outside my home?

Yes, but not overnight without express written approval by the HOA Board. Please notify a board member by sending a message on our Contact Us page.

Can I use a golf cart to get around the neighborhood?

No, as per County Ordinance 210-48 (a) – A Golf Cart shall not be operated on any County Road, except a Designated County Road that has been appropriately marked with signs by the County Engineer.

What does my HOA fee cover?

Maintenance and management of the common areas of the retention pond, park and streetlight payments.

Do I need a building permit to remodel the inside of the house?

No, not if you are doing basic remodeling like painting, flooring, changing out appliances. If you are doing structure remodeling then you will need a permit from the Architectural Committee as well as the County.

Do I need permission from the Achitectural Committee to replace my fence?

Yes, please download and fill out a form from the Forms Page.

What days are garbage, recycling and yard waste pick up?

Garbage-household trash day is Tuesday.
Recycling is picked up on Wednesday.
Yard waste is picked up on Thursday.

The company that picks up our waste has asked that all trash/waste is out to the curb by 6:00am.

I have low water pressure/a water leak in front of my home, who do I call?

Please call St. Johns County Utility Department at (904) 209-2700.

How can I submit an item/topic to be discussed at the next Board Meeting?

The topic for the agenda has to be approved by the President, please email request to CaptainsPointePresident@gmail.com. The agenda is set the Monday before the meeting.

Do I need a special permit to fish in the Captain's Pointe pond?

No, just a valid FL State Fishing License.

Can I park my Boat/Recreational Vehicle on my property?
